TikTok Appeals to Overturn Ban Act, Claims DOJ Misrepresentation

August 16, 2024 – According to a report by Reuters today, TikTok, owned by ByteDance, urged a federal appeals court on Thursday to overturn the injunction act that “requires ByteDance to sell TikTok’s U.S. assets,” arguing that the relevant charges by the U.S. Department of Justice contain misrepresentations.

In the appeal document submitted on Thursday, TikTok emphasized that its content recommendation engine and user data are stored on cloud servers operated by Oracle Corporation in the United States. Additionally, content moderation decisions affecting U.S. users are also made in the United States.

It was reported in April this year that the U.S. Senate passed a bill with a overwhelming majority of 79 votes in favor and 18 against, which could potentially lead to a ban on TikTok in the United States. The bill requires ByteDance to sell TikTok; otherwise, it will face a ban.

This bill, named the “Protecting Americans from Foreign Adversary Controlled Applications Act,” will be submitted to President Joe Biden for signature into law, and Biden has indicated that he will sign the bill. However, TikTok is actively seeking to overturn this potential ban through legal means.
